Smash Happy Audio ("Smash Happy Audio," "we," "us," or "our") operates smashhappyaudio.com (the "Site") and provides audio plugin software and related products (the "Products"). This Privacy Policy explains what information we collect, why we collect it, and how it's handled.

We are based in Kamloops, British Columbia, Canada, and this policy is written with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA) as its primary framework. If you're located in the European Economic Area or the United Kingdom, the section below on your rights explains the additional protections available to you under the GDPR/UK GDPR.

1. Information we collect

Information you give us directly:

• Name and email address, when you create a Portal account, contact support, or join a mailing list or waitlist (e.g. the Reach waitlist).
• Purchase and license information (which Products you've licensed, license key status, activation count) — this is collected and stored to run the Portal account/license system, described further below.
• Any content you send us directly, such as support emails or messages.

Information collected automatically:

• Basic technical data when you visit the Site (browser type, device type, pages visited, referring page, approximate location derived from IP address) via standard web server/CDN logs.
• We do not currently use third-party advertising trackers or sell any data to data brokers.

Information from our payment processor:

• All purchases are processed by Lemon Squeezy, who acts as the Merchant of Record for every sale. Lemon Squeezy collects your payment details (card number, billing address) directly — we never see or store your full payment card details. Lemon Squeezy shares with us the information needed to fulfill your order and provide support: your name, email address, purchase date, product purchased, and order/license ID. Lemon Squeezy's own handling of your payment data is governed by Lemon Squeezy's Privacy Policy.

2. How we use your information

We use the information above to:

• Deliver purchased Products, license keys, and software updates.
• Operate your Portal account and verify license activations.
• Respond to support requests.
• Send purchase confirmations, license/download information, and (only if you've opted in) occasional product news.
• Maintain, secure, and improve the Site and Products.
• Meet legal, tax, and accounting obligations.

We do not use your information for automated decision-making that produces legal or similarly significant effects on you.

3. Who we share information with

• Lemon Squeezy — our Merchant of Record, handling all payment processing, sales tax/VAT collection, and refund processing.
• Hosting/infrastructure providers (e.g. Cloudflare) — to serve the Site and Portal reliably and securely.
• We do not sell your personal information to third parties, and we don't share it with anyone else except as required by law, to protect our legal rights, or with your consent.

4. Cookies

The Site may use strictly necessary cookies to keep you logged into the Portal and, if analytics are added in the future, basic first-party analytics cookies. We do not currently use third-party advertising cookies. If that changes, this policy will be updated and, where legally required, we'll ask for your consent first.

5. Data retention

We retain account and license information for as long as your account is active, and for a reasonable period afterward to meet tax, accounting, and legal obligations, resolve disputes, and enforce our agreements. You can ask us to delete your account information at any time, subject to the legal retention needs described above (e.g., we may need to retain basic purchase records for tax purposes even after deleting an account).

6. Your rights

All users: you can ask us, at any time, to (a) tell you what personal information we hold about you, (b) correct inaccurate information, or (c) delete your information, subject to legal retention requirements. Contact us at the email below to make a request.

If you're in the EEA or UK, you additionally have rights under the GDPR/UK GDPR to data portability and to object to or restrict certain processing, and the right to lodge a complaint with your local data protection authority. Our legal basis for processing your information is performance of a contract (fulfilling your purchase), our legitimate interests (running and securing the Site), and, where applicable, your consent (e.g. marketing emails).

7. Children's privacy

The Site and Products are not directed at children, and we do not knowingly collect personal information from anyone under 16. If you believe a child has provided us information, contact us and we'll delete it.

8. International transfers

We are based in Canada; our service providers (including Lemon Squeezy and our hosting provider) may process data in other countries, including the United States. By using the Site or Products, you understand your information may be processed outside your home country.

9. Changes to this policy

We may update this policy from time to time. Material changes will be reflected by an updated "Last updated" date above, and where appropriate we'll provide additional notice.
